Rental Property Smoke Alarm Legal Requirements
The Australian Government has stringent requirements for all landlords in relation to smoke detector alarm systems, with hefty fines for non-compliance. Requirements include:
- Working smoke alarms installed in all rental properties in accordance with Australian Standard 3786.
- Alarms must be located in compliance with BCA requirements.
- All smoke alarms must be tested and cleaned within 30 days before the start of a tenancy agreement.
- Replacing batteries that are flat or almost flat within 30 days before the start of the tenancy in compliance with the manufacturer's instructions.
- Replacing smoke alarms before they reach the end of their service life.
- Having checked by a competent professional, any smoke alarm that a tenant has reported as not operating, and repair or replace the smoke alarm as required.
